Using the webshop
We created the webshop with services and facilities which make it easy for you to find and purchase the product you want. The functions of the webshop was tailored to the needs of personal shopping, and tried to help shopping with further ideas. To assist in choosing a product, we try to provide as much information on the chosen product as possible.
In our webshop you can ne informed about our product without the need to order. In this case you do not need to provide your data. During browsing without login and registration you can still select products which are stored in a temporary storage, and if you register by providing your data, these products can be ordered immediately, so there is no need to choose them again after login. A multi-level menu structure was created to view the products. The links on the main page help to select the main product category which includes further subcategories. By clicking on the desired product category, a detailed product list appears. Here you can select between products and get to the detailed product information pages which contain photo and description. The price can be seen above the photo, the product can be added to cart at the bottom of the page. If you wish to view other products, use the browsing buttons available on every page of the webshop to continue browsing.
The *QUICK SEARCH function is to make purchase and selection easy because by entering a word or part of word you can search in the product ID, name and description.
Valid order can be submitted after registration - by providing your delivery and billing data - either via e-mail or phone. During registration the form has to be filled accordingly. Of course, it is possible to enter different delivery and billing addresses, so even a present can be sent from our webshop. Prior to or after registration the product can be added to your cart. Here you can specify the method of payment and delivery.

ACCEPTANCE OF GENERAL TERMS AND CONDITIONS
During registration and purchase (in both cases) if the user wishes to use the services
of the Webshop, he or she is to accept the present Terms and Conditions which can
be done by ticking the checkbox on the form. By accepting the Terms and Conditions,
a contract according to this Terms and Conditions is made between the Provider and

Creation of contract of sale:
If the user submits an order on the pages of the Webshop and the provider verifies the order via e-mail, a contract of sale is created between the customer (user) and the provider. (If the order verification e-mail is not received by the customer within 48 hours, the offer is no longer binding the customer, he or she is not obliged to purchase the ordered product or use the service.)
2. The user accepts that the contract made this way is considered to be made in writing and the legislation of Hungary applies. To the contract the present Terms and Conditions apply.
3. The contract is created in Hungarian and is stored by the Webshop automatically in electronic form. It is available for the user after logging in to the Webshop. Its content can be read, saved or printed.
The price of every device sold by us includes VAT and cannot be considered an offer!
The price indicated erroneously on the webshop is not considered an offer, it can be modified at any time, and, if the customer orders, we are not bound to sell the product at that price!

Main properties of the product can be viewed on the display pages of the products.
The prices indicated at the Webshop are increased with 27% of VAT and include the price of the products and the delivery to the ground floor.

Delivery times can be viewed on the display pages of the products.
The delivery is done in a time agreed between the provider and the customer.
The customer shall check the package at the time of delivery (or personal handover) for any damage. In case of damaged package the damage is to be registered in record on the spot.
POSSIBLE PAYMENT METHODS
In case of personal handover, payment in cash or credit card upon the receipt of
the product (on-delivery)

4. Bank transfer (transfer in advance)
is entitled to withdraw from this contract within 14 days without giving any reason.
Similarly, in case of contract for providing service, the completion of the contract
has begun, you are entitled to terminate the contract within 14 days without giving
any reason. If you wish to exercise your right of withdrawal/termination, you are
to send your declaration of withdrawal/termination to the following address (via
post, fax or electronic mail): (1132 Budapest, Váci út 6.). For this purpose you
may use the enclosed sample declaration of cancellation/termination.
Your right of cancellation/termination is exercised in time if the declaration of cancellation/termination is sent before the expiration of the deadline indicated above.
Legal effects of cancellation/termination
If you withdraw from this contract, we immediately, but at the latest, within 14 days from the receipt of your withdrawal, refund any compensation including costs of delivery (except the additional costs incurred from choosing a delivery method different from that offered by us as standard and at the lowest cost). During refund we use the payment method applied upon the original purchase, except if you give express consent for using other payment method; using this method will not incur any additional cost for you.
The refund may be withheld until the we have the returned product or you verified its returning: the earlier time is to be considered.

For the customer to exercise his or her right of withdrawal, the webshop is to publish a sample declaration which can be filled and submitted by the customer.
The customer is not obliged to use the sample document. Other form may be used. The declaration is to contain the data (required by the webshop to fulfill its obligations) of the customer, the time of purchase and the product must be able to be identified.
Notice on part warranty, product warranty and warranty
what cases can you exercise your part warranty right? In case of defective execution
you can request a part warranty from the enterprise according to the rules of Civil
What rights do you have based on your part warranty claim? You - upon your choice - may exercise the following part warranty claims:
You can request repair or replacement, unless the remedy of your choice is impossible or would incur disproportionate additional costs related to the completion of your other request. If you did or could not request repair or replacement, you can request proportionate discount from the compensation or have the product repaired on the cost of the enterprise, or, as a last resort, you can withdraw from the contract. You can transfer from your chosen part warranty right to an other, however, the costs of transfer is charged on you, unless it was justifiable or cause was given by the enterprise.
What deadlines apply for your part warranty claims? You are to report the error immediately upon its discovery or not later than 2 months from the discovery of the error. Be advised, however, that outside the expiration time of two years from the completion of the contract, you cannot exercise your part warranty right. In case of used product this limit is 1 year at most.
Towards whom can you apply your part warranty claim? You can apply your part warranty claim towards EURO HOME SHOP GSM Kft.
What are the other prerequisites to exercise of your part warranty rights? There is no additional prerequisite to the application of your part warranty claim within six months from the completion other than the reporting of the error if you can prove that the product or service had been provided by EURO HOME SHOP GSM Kft. After the expiration of 6 months from the completion, however, you are to prove that the error discovered by you had already existed in the time of completion.
what cases can you exercise your product warranty right? In case of defect in goods
(product), you - depending on your choice - may exercise your right described in
point 1. or product warranty claim.
What rights do you have based on your product warranty claim? As product warranty claim, you may request the repair or replacement of the defective product only.
In what cases can the product be considered defective? The product is defective if it fails to meet the quality requirements valid when it was marketed, or if it does not have the characteristics indicated in the manufacturer’s specifications.
What deadlines apply for your product warranty claims? You may exercise your product warranty claim within 2 years from the time the product was marketed by the manufacturer. Upon expiration of this time you are no longer entitled to this claim.
Towards whom and under what conditions can you apply your part warranty claim? You may exercise your product warranty claim exclusively towards the manufacturer or distributor of the goods. The defect of the product in case of exercising product warranty claim is to be proven by you.
In what cases will the manufacturer (distributor) be released from its product warranty obligation? The manufacturer (distributor) is released from its product warranty obligation only if it can prove that:
- it did not manufacture or market the product within the scope of its business activity, or
- at the present state of science and technology, the defect could not be recognized at the time when it was marketed, or
- the defect of the product originates from the application of legislation or mandatory regulatory requirement.
To be released from its obligation, the manufacturer (distributor) is required to prove one of the causes.
Be advised that due to the same defect, part warranty and product warranty cannot be exercised at the same time. In case of effective application of your product warranty claim, however, the part warranty claim for the replaced product or repaired part may be exercised towards the manufacturer. [If the enterprise is bound to provide warranty according to legislation or contract, the inclusion of the following 3. point into the notice is necessary:]

The Euro Home Shop GSM webshop sells only new products with warranty.
If you have purchased the defective product in person at our store, the warranty can be applied with the receipt of purchase in person within the opening hours of the store. The defective product will be tested on the spot and will be replaced immediately after the determination of the defect.
In what cases will the enterprise be released from its warranty obligation? The enterprise will be released from its warranty obligation only if it can prove that the cause of the defect arose after the completion.
Be advised that due to the same defect, part warranty and warranty claims, and product warranty and warranty claims cannot be exercised at the same time, otherwise your warranty rights remain unaffected regardless to the privileges described in points 1. and 2.
Method of filing warranty claims
1. Personal notification
The customer may report his or her warranty claim at the Provider (address of Provider). In this case the employee of the Provider makes a record of the objection, in which the following will be recorded:
- name and address of the customer,
- description and price of the product,
- date and time of the purchase,
- date and time of the report of defect, - the description of the defect,
- the claim to be applied by the customer,
- the method of settling the objection.
If the method of the settlement of objection differs from that of the customer’s request, its justification is included in the record.
A copy of the record is handed over to the customer.
2. Written notification
The customer may report his or her warranty claim in a letter sent to the Provider (address of Provider) or via electronic mail (e-mail address of Provider).
In this case the letter must contain:
- name and address of the customer,
- description and price of the product,
- date and time of the purchase,
- date and time of the report of defect,
- the description of the defect,
- the claim to be applied by the customer,
Description of liability issues, that is, in which cases or which defects will the Provider exclude liability. Example:
The user may use the website exclusively on his or her risk and accepts that the Provider cannot be held responsible for any material and non-material damage arising during use beyond the responsibility for intentional breach of contract causing damage to life, physical integrity and health, out of gross negligence or crime.
The Provider states that it excludes all liability for the conduct of the users of the website and that the user is completely and fully responsible for his or her conduct.
The user shall ensure that no rights of any third person or any legislation is violated directly or indirectly during the use of the website.
The Provider is entitled but not obliged to check any content made available by the users (for example comments) during the use of the website and the Provider is entitled but not obliged to seek any signs of unlawful activity and cannot be held responsible for them.
The entirety of the website (texts, images, graphical elements, etc...) is under copyright protection, thus it is forbidden to copy, modify and distribute for commercial purposes!
